Is there anything I can do?
We can enforce the law to stop debt collection abuse. Sometimes it is obvious that a debt collector’s intentional harassment or similar acts must violate the law. Often though, a debt collector’s practices and acts seem unfair, but the consumer is unsure whether the law has been violated. There are many consumer protection laws such as the Fair Debt Collection Practices Act that prohibit certain debt collection practices. For example, this office represented consumers and won a case because the language appearing in the collection letter violated the law. (To see it click here.) The Fair Debt Collection Practices Act was passed to help victims of debt collection abuse seek a remedy. If you think you have encountered a violation of the law and have suffered mental anguish stemming from the violation we encourage you to give us a call.
I WANT THE CALLS TO STOP. . . HELP!
There are ways to apply the law so that it will be unlawful for debt collectors to contact you directly under most circumstances. Under the Fair Debt Collection Practices Act a debt collector is not allowed to contact a person represented by legal counsel who is available and ready to communicate with the debt collector on that person’s behalf.
